TERMS OF SERVICE

1. Acceptance

These terms govern your use of LaunchSync (the "Service"), operated by Nishimoto Works, Inc. ("we", "us"). By using the Service, you agree to them.

2. What the Service is

1. LaunchSync is an unofficial fan-made companion application for watching rocket launch broadcasts.
2. It is not affiliated with, endorsed by, sponsored by, or approved by any space agency, launch provider, or broadcaster.
3. The Service is currently an open beta and is provided free of charge. We may change, add, or remove features at any time without notice. We may add paid features in the future. If we do, we will tell you beforehand, and we will say at the same time what happens to the features that are free today.

3. Launch information

1. Launch information comes from a third party (Launch Library 2, by The Space Devs).
2. Launch times change constantly. We make no warranty as to the accuracy, timeliness, or completeness of what is displayed.
3. Do not make travel, accommodation, scheduling, or any other commitments based on this Service. We are not liable for any loss arising from doing so.

4. AI-generated content

1. The flight controller messages and mission briefings shown in the Service are AI-generated dramatization. They are not real mission control transmissions and not official statements.
2. We make no warranty as to their accuracy.
3. Do not present anything shown in this Service to others as fact.

5. Flashing effects and sound — health warning

1. At T-0, the Service flashes the screen brightly and plays a loud sound.
2. If you have a history of photosensitive epilepsy, or believe you may be susceptible, do not enable effects.
3. Effects are armed only when you engage SYNC LOCK (LOCK & ARM). Until you do so, nothing flashes and nothing plays.
4. If you feel unwell while using the Service, stop immediately and seek medical advice if necessary.
5. We are not liable for harm arising from use of the Service without regard to this section.

6. Prohibited conduct

You must not:

1. Violate any law or public order
2. Place excessive load on our servers or network, or access the Service by automated means at scale
3. Disassemble, decompile, or reverse-engineer the Service
4. Present the Service as official, or describe it in a way that implies official affiliation
5. Present content shown in the Service as official information or as fact
6. Do anything else we reasonably consider inappropriate

7. Changes, interruption, and termination

1. We may change, suspend, or discontinue the Service at any time without notice.
2. The Service depends on third-party APIs and services. If those stop or change, the Service may become partly or wholly unavailable.
3. We are not liable for loss arising from any of the above.

8. Disclaimer and limitation of liability

1. The Service is provided "AS IS". We disclaim all warranties, express or implied, including accuracy, completeness, fitness for a particular purpose, and uninterrupted availability.
2. Except in cases of our wilful misconduct or gross negligence, we are not liable for any damages arising from your use of, or inability to use, the Service.
3. We are not responsible for external sites linked from the Service, nor for any dispute between you and those sites.

9. Intellectual property

1. Copyright and other intellectual property rights in the Service belong to us or to their rightful owners.
2. Third-party names and trademarks referenced in the Service belong to their respective owners.

10. Changes to these terms

We may revise these terms at any time. Revised terms take effect when posted on this page.

11. Governing law and jurisdiction

1. These terms are governed by the laws of Japan.
2. Any dispute relating to the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court in Japan as the court of first instance.
